Bada'i` al-Sana'i` fi Tartib al-Shara'i`: Adab al-Qadi

This is a translation of Adab al-Qāḍī, Book No, 53, of al-Kāsānī’s famous book Badā’i‘ al-Ṣanā’i‘. The major purpose of this publication is to present the authentic narration of Islamic law, with special emphasis on Ḥanafī law, to those who approach the subject in English. This has become extremely important in the present times when many scholars, and others, are expressing all kinds of views about Islamic law. Some of these views display a highly superficial knowledge of this sacred law that has been preserved meticulously by its guardians, the Muslim jurists (fuqahā’), for centuries. Besides this, under pressure to promote Islamic banking, the rules are sometimes stretched in a manner that will ultimately lead to the destruction, or a distorted version, of fiqh. There is, therefore, a dire need to know, and to show, what the jurists actually say. Imām al-Kāsānī's work was selected for this purpose, because it is authentic in its chain of transmission and is, at the same time, highly organised and topically arranged.
